Hundreds of Libyans handover their weapons
Hundreds of Libyans have converged on a main square in Benghazi in response to a call from the military to hand over their weapons, some driving in with armored personnel carriers, vehicles with mounted anti-aircraft guns and hundreds of rocket launchers.
A similar event was held in Tripoli Saturday. The call by the Libyan chiefs of staff was promoted on a private TV station earlier this month. But the call may have gained traction in the wake of the attack against the U.S. consulate in Benghazi in which the American ambassador and three staffers were killed. The attack was followed by a popular uproar against armed militias which have increasingly challenged government authorities.
The government had previously estimated that over 200,000 people in Libya are armed.

Financially, Nokia is in bad shape. It lost a billion dollars last quarter, which is only good news when you look at the quarter before that, which shows a $1.7 billion loss. Despite all this, Christof Hellmis, VP Location Platform at Nokia, doesn't seem to be the least bit concerned. In fact, he's rather chipper as he sits down with us at this year's Mondial de l'Automobile in Paris.
Perhaps that's because his division, Location & Commerce, is doing quite well indeed. Containing the remains of Navteq, L&C pulled down nearly €100 million profits in each of the past two quarters. It's a healthy golden goose in Nokia's rapidly shrinking barn. So why, then, is the company helping its competition improve their own offerings by providing more comprehensive navigation services baked right into Windows Phone 8? Mich. senators draft new law if voters say no
LANSING, Mich. (AP) ? The leader of the Michigan Senate said he and fellow Republican colleagues are armed with a proposal to replace the state law that lets emergency managers take over local governments in the event voters strike it down in November.
The behind-the-scenes effort, which doesn't appear to involve Republican House leaders or GOP Gov. Rick Snyder, aims to keep a form of the contentious law on the books while acknowledging some of the critics' concerns, which include that it takes too much power from local leaders struggling with budget deficits.
Senate Majority Leader Randy Richardville told The Associated Press on Thursday the move is not an admission that the current law is flawed, but the new draft takes those concerns into account. He said he couldn't provide details about the alternative bill because the draft is under legal review.
"If something happened like that bill was overturned, I think the Legislature would have to be ready to respond and to still deal with the emergency," Richardville said. "You can eliminate the financial manager from the emergency financial manager legislation, but you can't remove the emergency."
The legislative tinkering is the latest twist in the battle over the law that went all the way to the Michigan Supreme Court last month. The state's highest court ruled a union-backed referendum to repeal the law can go on the ballot in November.
The law passed last year by the Legislature and signed by Snyder allows the governor to appoint people to run cities and school districts that are broke. Managers have sweeping authority to cut spending, sell assets and tear up contracts without the approval of elected officials.
The city of Detroit, struggling with record deficits for years, narrowly avoided such a takeover earlier this year.
The law has since been suspended until the election and replaced by the previous public act that gives emergency managers fewer powers. But that's also being contested ? a lawsuit was filed this week by civil rights lawyers that claim the "old law is dead" because there is no legal framework to support it.
Emergency managers are operating in Benton Harbor, Flint, Pontiac and Ecorse, as well as in school districts in Detroit, Highland Park and Muskegon Heights.
Richardville said a replacement will be needed if the law is struck down.
"It's certainly a priority to make sure we help these communities out," he said. "We've had some real concerns that people in these communities could go without crucial services unless somebody was in there and given authority to fix things."
In Pontiac, emergency manager Lou Schimmel said his city and others will be "runaway fiscal nightmares" if the law is overturned and there is no substitute.
"There isn't anyone in this city who could run this city. ... We're not there yet," said Schimmel, who was appointed a year ago.
A spokesman for Republican House Speaker Jase Bolger said that chamber's Republican leadership isn't working on a replacement bill and declined to speculate on whether it would also become a priority for the House if the law is repealed. Still, spokesman Ari Adler said Bolger is concerned about what happens to communities with financial emergencies if the law is repealed.
"Speaker Bolger supports Proposal 1, but ballot proposals are a time when voters have their chance to speak directly and it's important for legislators to listen to what they say with their votes," Adler said.
Likewise, Snyder is instead focusing on "making the strong case for why Public Act 4 is a critical and necessary tool," said his spokeswoman Sara Wurfel.
"We have an obligation to ensure continuity, prevent chaos and ensure health, safety and welfare of citizens, but can't work in hypotheticals and will have to cross that bridge if and when we come to it," she said.
Robert McCann, spokesman for Senate Democratic Leader Gretchen Whitmer, said Democrats would prefer a bipartisan approach "rather than an end-around" by Republicans.
"They haven't shown great concern for community input up to this point," McCann said. "If this one is different, I think it would be a step in the right direction."
The Michigan Legislature has one session scheduled in October then doesn't reconvene until after the Nov. 6 election.

Carmageddon Turned Into Carmaheaven For Your Lungs
This weekend is carmageddon II in Los Angeles, when a sizable, well-trafficked chunk of the popular 405 freeway will again be closed to all motor vehicles. The previous one didn?t produce the traffic snarls that were feared, and it also didn?t produce something else?smog.
A new report from UCLA found that during that first closure of a 10-mile stretch of the 405 last year, air quality near the freeway improved immensely within minutes. Levels were as much as 83 percent better than on other weekends when the freeway was as clogged as ever.

?The air was amazingly clean that weekend," Suzanne Paulson, a professor of atmospheric and oceanic sciences at UCLA said in a news release. "Our measurements in Santa Monica were almost below what our instruments could detect, and the regional effect was significant. It was a really eye-opening glimpse of what the future could be like if we can move away from combustion engines.?
Because people were afraid of gridlock everywhere, they generally stayed off major highways around Southern California during carmageddon I. The result: air quality improved on average 25 percent in such far-flung areas as Long Beach, Santa Clarita, Ventura and Yucaipa, and it improved 75 percent in areas of West L.A. and Santa Monica. Those numbers even surprised the researchers.
But the effects were short-lived: by the following week, the skies were back to their usual smogginess.
What exactly are we taking in when we breathe smoggy air? Let?s start with ground-level ozone, which can react with the fluid lining of the respiratory tract, possibly causing inflammation. Fine carbon-based particles can also become irritants, and latching onto them may be polyaromatic hydrocarbons, known to cause tumors in lab animals.

While air quality has improved vastly in the Los Angeles basin since the 1970s, we?re hardly out of the woods. The increased health risks of being exposed to near-roadway pollutants, the researchers said, include heart attacks, strokes, asthma and even diabetes
Among the fine particles the scientists measured were ones known as PM2.5, which include tailpipe emissions. What?s unique about these particles is that they can travel farther from the freeway and hang around longer than other ultrafine particles.
"There is no safe level of PM2.5 concentrations, where you would no longer observe health impacts, so any reduction is an improvement," said associate professor of environmental health sciences Yifang Zhu. ?This study shows that with such dramatic traffic reductions, there are specific air-quality improvements. It gives policymakers and the public incentives to put more effort into reducing traffic emissions.?

As affiliate marketing matures, newer threats and challenges also evolve. However, the opportunities are still bountiful, and with the right approach a merchant can still succeed marketing their brand and business through a well-built affiliate program.
Today's guest is Todd Crawford, a recognizable affiliate marketing veteran, co-founder of Impact Radius, and former VP of sales and business development at Digital River's oneNetworkDirect.
In 1998 Todd also contributed to the founding team at Commission Junction, where he later served as Vice President for more than seven years.
What are the major challenges with which you see affiliate managers struggle?
Balancing time between revenue generating activities and administrative activities.? I think many people get bogged down with the day-to-day administrative tasks and don?t focus enough energy on the revenue generating part of the job.? The key takeaway is creating as many efficiencies as possible to minimize the time required for day-to-day stuff so you free up more time to develop incremental revenue opportunities.
What do you view as the main affiliate program growth opportunities?
The affiliate channel is often kept separate from other media and ad distribution channels because of the performance pricing.? There?s a significant opportunity to pull other distribution channels into the performance category because of the improvements in tracking and reporting. For example, a lot of companies offering distribution with mobile or through remarketing are willing to do so on a performance-basis. I think there?s a lot of room for growth and expansion with media partners that historically were bucketed in the display or search channels.
In April 2012 an Illinois Circuit Court Judge ruled the affiliate nexus tax unconstitutional. However, more and more states are considering going the route of the "affiliate tax". Is there a good solution to this snowballing affiliate nexus tax situation?
The only real solution is a national Internet sales tax or some kind of tax that applies equally to all advertisers regardless of the media type that drove the conversion.
How can affiliate networks help merchants to continue working in the states with the affiliate nexus tax legislation?
I am not sure that affiliate networks or any other third-party can help solve nexus issues.? Technology cannot solve nexus issues.? The advertiser is responsible for interpreting and complying with any and all applicable tax laws.? It has been my experience that advertisers rely on their legal counsel or CFO for this advice. Beware of technologies that tell you they can solve nexus issues.
What about the "Do Not Track" legislation? Is affiliate marketing industry in danger here? And does Impact Radius have relevant solutions?
I am confident that privacy and marketing can co-exist peacefully.? Eventually, websites will not be able to generate revenue if consumers opt out of monetization of content.? I believe these sites will restrict access to visitors that do not wish to be tracked.? Consumers will have a choice - visit our site and allow us to make money or do not access our content.? In the end, I think most consumers will understand this? trade off? as fair and reasonable and doesn?t compromise their person information or security.
What are the top 3 things that affiliate managers (and merchants) should be looking at while choosing an affiliate network?
Yes, I am really looking forward to participating on this panel.? The first distinction I would like to make is that Impact Radius is a technology provider, not a network - this puts us in a unique position to help advertisers and agencies better manage their top relationships - from both a cost perspective and an incremental revenue perspective.? The first thing to look for when selecting any technology vendor is how will it solve your problems or allow you to meet your revenue objectives? When choosing a network, you need to know how the technology will support your needs and objectives.?
The second consideration is cost.? Networks typically charge a fee based on the success of your program - the bigger it gets, the more you pay.? If you or your agency are doing all the work of growing the program, does this pricing model make sense for your business?? The third consideration is do you even need a network to attract and manage partners? Most advertisers see 90%+ of their volume coming from a handful of top partners. These top partners are generally well known in the industry and easy to contact and recruit - especially if you are a medium to large brand.
Over the next 4 years Forrester predicts a steady growth for affiliate marketing. What are the top 3 areas of opportunity for affiliates these days?
- Content -- Developing unique content that attracts repeat visitors is the single most valuable asset any publisher can invest in.
- Mobile -- I believe in a few more years mobile will surpass online - so the sooner you get there, the sooner you will be successful.
- Media -- Utilizing more accurate and flexible tools to enable and measure more media channels to increase traffic to your site(s). Do not rely solely on search (paid or organic) for your livelihood.? Diversification into other media channels reduces your dependence on one channel for the majority of your traffic.? If you?re not already testing social, retargeting, email, etc. - it?s time to start!
If you were to leave affiliate managers with just one advice today, what would it be?
Communicate the value of your channel (and your contribution) to internal teams throughout the week, month, quarter and year.? Utilize every metric available to you to understand how your channel compares and interacts with other marketing efforts and educate your company on what you?ve learned.

PHILADELPHIA (AP) ? Thousands of conservative Christians gathered Saturday on Independence Mall in Philadelphia to pray for the future of the United States in the weeks before the presidential election.
Religious broadcaster Pat Robertson and Family Research Council president Tony Perkins topped a full day of speakers at "The America for Jesus 2012" prayer rally.
Robertson, a former Republican candidate for president, called the election important, but didn't mention either major political party or candidate by name.
"I don't care what the ACLU says or any atheists say. This nation belongs to Jesus, and we're here today to reclaim his sovereignty," said Robertson, 82, who founded the Christian Coalition and Christian Broadcasting Network, and ran for president in 1988.
Organizers plan another prayer rally Oct. 20 in Washington, D.C., two weeks before President Barack Obama faces Republican Mitt Romney in the presidential election.
Perkins asked the crowd to pray for elected officials including Obama.
"We pray that his eyes will be open to the truth," Perkins said.
A number of event organizers, though, have been vocal critics of the Democratic president.
Steve Strang, the influential Pentecostal publisher of Charisma magazine, which was distributed at the rally, recently wrote in a blog post that America is under threat from a "radical homosexual agenda." He also said Obama "seems to be moving toward some form of European socialism."
And speaker Cindy Jacobs has blamed a mysterious Arkansas bird-kill last year on Obama's repeal of the policy known as "don't ask, don't tell," which allows gays and lesbians to serve openly in the military.
Speakers throughout the day condemned abortion, gay marriage and population control as practiced by Planned Parenthood. Christian rock music filled the historic mall as speakers challenged the crowd to overcome the seven deadly sins: pride, greed, lust, envy, gluttony, wrath and slothfulness.
The rally was held outside of Independence Hall, where the Declaration of Independence was signed. Pennsylvania is also where evangelist George Whitefield preached during the first Great Awakening, the 18th-century religious revival that spread through the American colonies.

MEDINAH, Ill. (AP) ? Ian Poulter came through again, teaming with Justin Rose for a 1-up victory over Bubba Watson and Webb Simpson and giving Europe a point it desperately needed Saturday at the Ryder Cup.
The Americans lead 6-4, but are up by multiple holes in the remaining two foursomes.
Led by Keegan Bradley and Phil Mickelson, who are 3-0 after a 7-and-6 thrashing of Lee Westwood and Luke Donald earlier Saturday, the Americans have been overwhelming.
Europe has had few answers, and captain Jose Maria Olazabal turned to Poulter and Rose to try and stem the momentum. Poulter holds the European record for winning percentage at 10-3-0, and he didn't disappoint Olazabal.
They played just well enough to hold off the Americans, closing out the match when Simpson missed an 8-footer.

So there still is time for Congress to act to renew the five-year legislation which last was updated in 2007.
While we wait, and since the fate of crop?subsidies are one of the forefront issues in the crafting of a new farm law, you might want to take a look at whom in your region benefits from existing subsidies.
The Environmental Working Group offers a Farm Subsidy Database that?s searchable by ZIP code, and your readers might find the result of a search quite enlightening.? I live in a suburb of Detroit that adjoins some pastoral areas but is hardly an agricultural mecca, yet a search of just my ZIP code turned up dozens of recipients of the farm subsidy, mostly for corn, wheat and soybean crops.? Some of the names I recognized as local businesspeople who practice trades and professions unrelated to farming. Apparently 40-plus local residents, however, hold enough acreage to get government payments ranging from a few hundred dollars to five-figure amounts.
The database includes figures back to 1995 and drills down to specific programs and crops for each landowner (individual or business) listed.? One local market garden, for example ? the kind that sells tomatoes, pick-your-own?pumpkin and corn-on-the-cob at roadside stands ? apparently dabbles in wheat and soybeans, too, and has reaped?disaster assistance and other payments in the six figures.
This information just screams out for an interactive map or other graphic showing the?location of farm subsidy recipients and what programs they were helped by.? Clearly these operators will have an opinion on the proposed revisions to the farm bill ? including the replacement of subsidies with insurance ? and you can use their stories to help illustrate the possible ramifications, pro and con, of?an overhaul to the programs.
Another area to look at is state property tax breaks for farmland; I nosed around in my state not long ago and found examples of hobby farms ? spreads that were mainly residential but that might have a pet goat or horse or some such and might sell a few hundred dollars worth of produce each year?? getting hefty tax breaks.? A number of other advocacy groups, industry groups and other stakeholders also offer their versions of online primers and update sites related to the bill.? And the New York Times also has a handy farm bill channel where related stories are compiled.

There are sometimes I am so over the sad stories I hear in the news ? both human news and pet news. It seems to be all we hear lately and well, that can start breaking our hearts the more we hear them.
Then, once in a while I come across a story that just warms my heart. It stands out from the rest of the sad news and can remind me that the world is a super sweet place.
A story came out a few days ago from?Minnesota and it involves two of the cutest creatures on the planet ? a dog and a tiny kitten.
A woman named Pat Weber owns a barn in?Jordan, about 40 miles southwest of Minneapolis and was enjoying the day with her grandson on September 24th, 2012. He was playing in the barn when he found a tiny kitten ? only about 2 inches long.
Weber says the tiny kitten was ?ice cold? but after feeling it move, she wrapped it up in a warm towel and brought it inside. That?s when the story gets adorable (promise, this isn?t a sad story about a forgotten kitten).
Weber has a 4-year old dog named?Mittens (aaw!) and when she heard the tiny kitten start to meow, she was interested. The tiny kitten nuzzled into Mittens, who started to lick her, and the kitten started?suckling, nursing on Mittens who hasn?t had her own litter for 2 years.
It took about 3 days for Mittens to start to produce milk according to Pat and ever since, Mittens has been a loving adopted mother to the tiny grey kitten who has been named Bootsie.

Police in Roseville, Mich., drilled into the ground Friday and took soil samples in the latest effort to find the remains of notorious Teamsters boss Jimmy Hoffa.

The decades-long investigation for Hoffa's body has had false leads before, and some experts are already knocking down the idea that Hoffa, who was last seen on July 30, 1975, outside a restaurant in Oakland County, Mich. -- 30 miles west of where police dug Friday -- could be buried in Roseville, a Detroit suburb.
The most recent investigation was launched after police in Roseville received a tip from a man in August who said he saw a body being buried underneath the driveway 35 years ago and "thinks it may have been Jimmy."
Police dug for about an hour and a half on Friday morning. They told NBC News' John Yang they were collecting soil samples around the home because ground-penetrating radar indicated the presence of something about two feet below the surface; officers came out of a shed with two cylindrical soil samples that were two inches in diameter and six feet long.
The soil samples are going to be hand-delivered by Roseville Police Chief James Berlin to a Michigan State University forensic anthropologist, who is expected to have the results of the samples as early as Monday afternoon. If human remains are found, the ground will be dug up.
The shed on the Roseville home's property is not the same one that was there when Hoffa disappeared in 1975, the police chief said.?
The tipster who prompted the search spoke with police on Aug. 22 and didn't come forward sooner out of fear, reported WDIV in Detroit.
Feisty and iron-willed in contract talks, Hoffa was an acquaintance of mobsters and adversary of federal officials. He spent time in prison for jury tampering.?
The day he disappeared, Hoffa was supposed to meet with a New Jersey Teamsters boss and a Detroit mafia captain. He was declared legally dead in 1982.?
Previous tips led police to excavate soil in 2006 at a horse farm more than 100 miles north of Detroit, rip up floorboards at a Detroit home in 2004 and search beneath a backyard pool north of the city in 2003.
There were even rumors that Hoffa's remains were ground up and tossed into a Florida swamp, entombed beneath Giants Stadium in New Jersey or obliterated in a mob-owned fat-rendering plant.
Roseville is one of several inner-ring communities that grew quickly as unionized auto factory workers left Detroit in search of nicer homes and bigger yards.

News of the latest search has brought attention to the mostly working- and middle-class suburb from the curious and naysayers. Slowly moving vehicles have clogged the residential street where the home sits as camera-wielding neighbors snapped photos for keepsakes.
"I believe it's him. My sister said it is, and she's a psychic," Mike Smith said after ambling up to the home Thursday and shying a bit from the yellow police tape stretched across the driveway.
One theory that has endured was that the body was beneath the foundation of a downtown Detroit hockey stadium, said 57-year-old Cindi Frank, who snapped photos Thursday of the Roseville driveway.

The daughter of a unionized driver and salesman for a Detroit bakery, Frank remembers conversations about Hoffa while he was alive and rumors about his fate.
"It was a family thing. Every time we'd go somewhere we'd say, 'Hey, I wonder if Jimmy Hoffa is buried there?'" Frank said. "It's just been one of those unsolved mysteries that's gone on for 30-something years. If he show up in Roseville ..."
Recently retired Detroit FBI chief Andrew Arena is among the doubters that the latest report will check out.

"You've got to check it out, but this doesn't sound right," he told the AP. "The working theories that have developed over the years, this really doesn't fit any of those. If this was the mob and they killed somebody, I just don't see them burying the body basically at the intersection of a residential neighborhood with this guy standing there."?
Some think the least likely spot for him to turn up might just be the place he does.
"Maybe the most inconspicuous spot might be the place to stash a body or something," said 52-year-old Andrew Kacir, who lives across from the taped off driveway.?

Under Polish law, ownership is the broadest title to real property, under which the owner of real estate is entitled to use an area of real estate for an unlimited period of time, exclusively, and may freely dispose of his right to the real estate. The ownership right may only be limited by (i) statutory law, (ii) principles of community life and (iii) the socioeconomic purpose of right.
According to the Act dated 24 March 1920 on the acquisition of real property by foreigners, the acquisition of real estate by a foreigner generally requires a permit issued by a minister competent for internal affairs in the form of an administrative decision.
In Poland, the courts maintain land and mortgage registers (ksi?gi wieczyste) for real properties. The registers describe, in particular, the legal title to, and encumbrances on, real properties. If there is a discrepancy between the legal status of a real property entered in a land and mortgage register and the actual legal status of that real property, the legal status entered in the register protects a bona fide purchaser who purchased the real property for consideration ? so-called ?public trustworthiness of land and mortgage registers? (r?kojmia wiary publicznej ksi?g wieczystych).
A practical consequence of the ?public trustworthiness of land and mortgage registers? is that if, on the date of the execution of a sale agreement transferring the ownership or the Right of Perpetual Usufruct (?RPU?) of a real property the seller is entered as, respectively, the owner or the perpetual usufructuary in the land and mortgage register, the purchaser will effectively purchase the title even if the seller does not hold that title.
The ?public trustworthiness of land and mortgage registers? does not apply in some cases, in particular if the purchaser, when purchasing the real property, knew or could have easily become aware that the legal status disclosed in the relevant register differed from its actual legal status, e.g. that the seller was not the owner/perpetual usufructuary of that real property.
Access to Land and Mortgage Registers is granted publicly so that everyone can check the content of the register (access to the content of the whole file of documents concerning a given real estate is however limited to entities holding a proven legal interest). RPU ? general remarks
In many aspects, the Right of Perpetual Usufruct (u?ytkowanie wieczyste) is similar to freehold. Perpetual usufruct resembles a leasehold established for a period of 40 to 99 years (with the possibility of an extension), but the legal nature of this right should be considered more as a freehold. Only lands owned by State Treasury and situated within the administrative limits of towns and settlements, lands owned by State Treasury situated beyond those limits but covered by a real estate local zoning plan of a town or settlement and designated to serve its economic needs, and lands owned by municipalities or their unions, may be held under perpetual usufruct.
The perpetual usufructee is entitled to: (i) use the land exclusively, (ii) dispose of his right to the land, (iii) erect buildings and facilities on the land, as specified in the perpetual usufruct agreement, (iv) own buildings and other facilities erected on the land let for perpetual usufruct (this right constitutes an exception to the suprficies solo cedit rule), (v) to exercise the right of purchase the land when an owner of the land wants to sell it, (vi) to request an extension of the right of perpetual usufruct for a further 40 to 99 years, within the last 5 years before the expiry of the original time of the perpetual usufruct, (vii) to obtain remuneration for the buildings and other facilities erected on the land upon the expiry of the perpetual usufruct, (viii) to enjoy the right to transform the perpetual usufruct into the ownership when specific requirements are met.
Perpetual usufruct is established by an agreement between the owner of the land and the perpetual usufructee. The agreement should specify the manner of the use of the land (?purpose of the land?) and the period of time for which the perpetual usufruct is established. If the land is let for the purpose of erecting buildings or other facilities, the agreement should specify: (i) the dates on which the work is to begin and to end, (ii) the kind of buildings or facilities, and the obligation to maintain them in the proper condition, (iii) the condition and the dates of rebuilding the buildings and facilities if these were destroyed or dismantled during the period of perpetual usufruct, (iv) the consideration due to the perpetual usufructee for the buildings or facilities existing on the land on the day when the perpetual usufruct expires.
An agreement establishing perpetual usufruct must be concluded in the form of a notarial deed. Moreover, in order to create a valid right, a perpetual usufruct has to be entered into land and mortgage register. Other issues connected with establishing and transferring perpetual usufruct are correspondingly governed by the provisions concerning the transfer of the ownership of real estate. Perpetual usufruct is formed for a ?purpose? and it should be remembered that if the property is being used contrary to its purpose, the owner may terminate the perpetual usufruct.
Both ownership and perpetual usufruct rights are entered into the Land and Mortgage Register maintained by local district courts. With respect to perpetual usufruct, entry in the Land and Mortgage Register is required for the perpetual usufruct right to be effective (with entry the perpetual usufruct rights become effective from the date on which the relevant agreement for its establishment was entered into).
Alternative titles to land for construction purposes
InPolandany investor, prior to obtaining the construction permit, needs to have a legal title to land on which the investment will be localized. Apart from ownership or RPU sucj legal title could be secured in the following way:
Transmission easement
The transmission easement is an institution of Polish law allowing business entities to use a landlord?s land in a determined way for the purpose of constructing and/or operating public utility facilities, either for remuneration, or gratuitously.A transmission easement is a limited right in rem. It is strictly connected with the term ?transmission facilities?. As a general rule, under Polish law buildings and other facilities permanently connected with the land are considered component parts of the land, and therefore they, in principle, constitute the property of the landowner. However, they are not treated as a component part of the land if they constitute a component of an enterprise (in such circumstances the ownership of the facilities is separated from the ownership of the land on which the facilities are set up, and the transmission facilities are owned by the relevant enterprises? owner). A transmission easement consists in the right of its holder, who intends to construct facilities for the transmission or distribution of gas or other similar facilities, to construct such facilities, operate them, and subsequently to access them for maintenance.In order to establish a transmission easement, the provisions of the Polish Civil Code require an agreement to be concluded between the landowner and the investor. A transmission easement agreement should include provisions regarding the description and scope of the easement, as well as the remuneration for the land?s use. If a landlord refuses to conclude a transmission easement agreement and the easement is necessary for the proper use of the transmission facilities, the energy company may submit an application to the civil court and require the establishment of the easement for the relevant remuneration. In order to obtain a satisfactory court decision, the applicant should prove that the establishment of a transmission easement is necessary for the proper use of the transmission facilities. However establishment of the transmission easement using court proceedings is a long-lasting process. A transmission easement may be entered into land and mortgage register (which is recommended from the legal point of view to fully secure investor?s rights).

Another way to secure the title to the land for the purpose of the construction of is execution of tenancy agreements with the landowners. A tenancy agreement may be entered into land and mortgage register (which is recommended from the legal point of view to fully secure investor?s rights).
Administrative decision limiting the right of the landowner
The county governor (starosta), executing tasks in the scope of government administration may, by decision, impose restrictions on the manner of real estate use, by granting permits for installing and laying real estate drainage systems, lines and facilities for the transport of liquids, steam, gas or electricity (including flowlines / pipelines) and public communication facilities and signalling facilities, as well as other underground, land or overhead facilities necessary for using the above mentioned lines and facilities, if the owner (or the perpetual usufructee) of the real estate does not grant permission. The restrictions shall conform to the local zoning plan (if one exists) or to decision determining the location of public purpose projects.
The permit may be granted ex officio or upon a motion of the interested entity. Granting of a permit shall be preceded by negotiations conducted with the owner (or perpetual usufructee of the real estate for obtaining the consent for the execution of the works. The negotiations shall be conducted by the person or entity intending to file a motion for the permit. The motion should be accompanied by documents evidencing these negotiations. The person or entity seeking the permit shall restore the real estate to the former condition immediately after the completion of works. When the laying or installation of the systems, lines and facilities mentioned above renders the owner or perpetual usufructee incapable of properly using and enjoying the real estate in a previous manner or in accordance with the previous purpose of the real estate, the owner or perpetual usufructee may demand that the county governor (starosta) or the person or entity applying for the permit buy from them for the State Treasury, the ownership or the perpetual usufruct rights to the real estate. The final decision shall constitute the basis for the entry in the land and mortgage register.

What Is A Workforce Computing Strategic Plan...And Why Do You ...
Regardless of what our minds conjure up when we think of airline travel, one thing we can readily observe is that while the weather, the experience of the flight crew, the mechanical condition of the aircraft, and the destination of the flight are all variables, the system?of getting an aircraft from one place to another, in one piece, is extraordinarily reliable. Herb Kelleher of Southwest Airlines once joked that the airline business is the only place where the capital assets travel at 500 miles per hour.
Every commercial flight starts with a flight plan, a flight crew, an aircraft, and a destination. The dispatcher creates the plan based on the expected conditions for the flight, the limitations of the pilot and passengers, and the capabilities of the aircraft. Time is built into the plan to climb to cruise altitude and to descend again to reach the destination safely. How much fuel will be required is built into the plan and pumped into the tanks. Every activity is done to achieve a singular purpose: getting the aircraft and its passengers safely to the destination, and everyone involved knows where the destination is. Aviation is a study in viable systems design.
How strange it seems then, that thousands of IT projects begin every day, but more than one-third of them crash enroute. Why? I would argue that it's because there is seldom a clear destination in mind, a rational plan to get there, or a viable system approach?in place to execute the plan. Most of the time, the destination and the means to get there are only vague estimates, and the elements of the strategy are rooted in hope.
A viable system approach is the inspiration behind Forrester's Workforce Computing Strategic Plan research. A viable system for workforce computing requires five things:
- A clear understanding of the aim of the organization.
- A clear understanding of how each project will help to achieve the aim of the organization.
- A clear understanding of the destination for each project.
- Organizations capable of reaching the intended destinations.
- A clear definition of the?system?needed to reach each destination.

W. Edwards Deming, widely credited as the father of the Japanese quality movement, said it best: "If you can't describe what you're doing as a process, you don't know what you're doing." Every activity must be a step in a sequence of events intended to achieve a clear purpose.
How does it apply to your IT organization and workforce computing specifically? If the aim of your organization is to become the largest provider of farm equipment in the world, and the core business strategy to reach the goal is to provide the highest quality farm tractors at the lowest possible cost, then every workforce computing initiative must be evaluated and prioritized based on how well it will help employees achieve the business strategy and reach the business' destination. Further, each project must begin with a close look at the conditions outside, a clear understanding of the capabilities of the organization, the limitations of the equipment, and agreement that the destination is truly within reach. Anything less creates a corrosive culture of mistrust and systemic failure. Culture is the responsibility of leadership.
Hope is not a strategy. The more your organization knows about the conditions outside, the more that people are encouraged to learn and prepare, the more understanding they have of the aim of the business and how their work contributes, the more accurate the strategic planning, the more reliable the execution, and the more rewarding it will be for the people involved. Competitive advantage doesn't come from reactive cultures; it comes from awareness, deliberate action, and careful sculpting of organizational and human capabilities to achieve what your competitors cannot. Most of all, it requires executive leaders who understand systems thinking and who are capable of crafting organizational systems to achieve the aim of the business.
Is the aim of your business clear and the goals within the capabilities of the people and equipment you have? Is your current workforce computing strategy focused clearly on helping employees achieve the goals of the business, or is it centered on other priorities such as security, control, and lowest cost? Is your VDI project headed for failure from the start, or is there a viable system in place to reach a clear destination? If in doubt, you need a workforce computing strategic plan.
