Unfortunately, in the spirit of ?all good things must come to an end?, let us now reflect on the ?Combined Loss and Expense Ratios? (again, WCIRB/circa 4/12/12).

Unfortunately, it has been the insurance industry?s tendency to not take gradual, incremental rate increases, as the CIRB and the California Department of Insurance have made advisory rate increase recommendations over the last 18 months. (Can anybody spell ?leadership??) This reticence has short-term benefit to California Employers but typically results with a tsunami-effect of larger increases culminating when all the ?dark planets align?.

The CIRB will recommend, again, a 12.6% average pure premium rate increase that would be effective Jan. 1, 2013 for new and renewing policies. These rate increases must be approved or rejected by California?s Department of Insurance, which can only recommend that insurers consider rate increase or decreases. Yes, California is an ?Open Rating State?.

Last week, the rating bureau?s governing committee unanimously voted to authorize the rate filing.? It would raise the average advisory rate to $2.68 per $100 of payroll, up from $2.38 per $100.

Help is on the way?

Meanwhile, a workers? compensation reform bill set to be proposed in California would limit some companies? ability to self insure for workers? comp claims, and would allegedly increase total permanent disability benefits for workers by $720 million per year. California Senate votes for 'sweeping' pension reform; Legislature poised to vote to reform workers comp

SACRAMENTO -- The state Legislature today overwhelmingly approved a controversial pension reform bill as it also considered overhauling workers' compensation as part of what's expected to be a marathon last day of the legislative session.

The bill passed, AB 340, on a 50-8 vote, with two Republicans voting for it and two Democrats voting against it. Of the 22 Assembly member not voting, 19 were Republicans, three were Democrats.

The Senate later passed it 36-1, with Sen. Joel Anderson, R-San Diego, the only no vote.

California Gov. Jerry Brown, who calls the reform "sweeping," is expected to quickly sign the bill.

The legislation caps benefits for new public

employees who make more than $132,120, eliminates "spiking" and raises the retirement age for new employees. That and other fixes are estimated to save between $40 billion and $60 billion over 30 years.

"Pension reform is long overdue and we can take a bold step forward by passing it today,'' Brown said before the vote.

Critics say the plan won't come close to reining in runaway pension costs that are stressing state and local governments obligated to pay the bills.

When the debate over pensions began, state Senate leader Darrell Steinberg said, it was the egregious six-figure pensions, the double dipping, spiking and other abuses that outraged the public.

"This package we voted on deals with all that and a whole lot

more," said Steinberg, D-Sacramento. "There are those who defined pension reform as eliminating defined-benefits middle-class pensions. I wouldn't go for that.

"I hope this puts this issue, which has so dominated our public discourse for a long time, if not away, at least to the side."

Steinberg disagreed with criticism that the reform failed to cut deeply into the the state's long-term pension liabilities, but said he is open to looking into reforming public employees' health benefits as part of implementing federal health-care regulations.

Assemblyman Jim Beall, D-San Jose, said the bill wasn't perfect but it's a start .

"Is now the time to defer this, or should we start the process?" Beall said. "We'll have to watch this over the next several years, but let's take this considerable step now."

Assemblyman Chris Norby, R-Fullerton, said the Legislature should have deferred to Brown's 12-point plan proposed last October. Democrats, he said, "emasculated and gutted and amended" the governor's proposal.

Republicans questioned whether labor truly was as outraged as they've expressed.

"This is a very, very, very short haircut for unions," said Assemblywoman Shannon Grove, R-Bakersfield.

"Each of us know in our hearts that this is a small, small, small step," said Sen. Mark Wyland, R-Escondido.

Under the reform, someone working for 30 years and retiring at 55 would get 48 percent less than a current employee, said Sen. Joe Simitian, D-Palo Alto.

"You hear me right," Simitian said. "The difference between what we're obliged to pay today and what people will be entitled to is close to half. I don't think anyone can call that nibbling around the edges."

Legislators are also tackling workers compensation reform, aimed at providing relief to workers who suffer injuries that don't knock them out of the workforce but affect their ability to make the same wages that they'd made in their previous job.

The reform is backed by labor groups and small business groups -- with large employers on the sidelines. But applicant attorneys oppose it because it makes it more difficult to bring injury cases to the courts. The money that would go into a fund for the newly classified injured workers would be taken from a fund that goes toward higher awards.

Brown said the bill would "avert an imminent crisis where workers suffer and rates will skyrocket. That happened in 2004, but this time, we have the chance to fix a problem before it becomes a crisis. We have the chance to make the Workers' Compensation System better -- much better -- for workers and cheaper for business."

Brown hopes to use the reforms -- and other cost-cutting moves he made this year -- to enhance his chances to win voter approval of his tax-hike initiative, Proposition 30, in November. His proposal would raise income taxes on the wealthy and boost the sales tax by a quarter cent, raising about $6 billion a year, enough to prevent massive new cuts to schools and colleges.

Brown's initiative leads in the polls, though by a narrow margin. A rival tax initiative for schools, Proposition 38, the measure backed by wealthy civil rights attorney Molly Munger, has lagged in the polls.

Legislators produced the pension legislation, AB 340, earlier this week, pounding out a 40-page bill with no time left to send it to the floor after months of negotiations with Brown. Republicans complained that Democrats were rushing through a bill with little scrutiny.

But the howls of outrage came from labor groups, who said that they were being thrown under the bus by Brown and Democrats.

Pension reformers say the legislation fell short of the larger need of tackling unfunded liabilities for retirees and current employees, estimated around $150 billion.

The legislation would require new and current public employees to pay at least half of the payments to their pensions, sharing the burden with their employers. It would also raise the retirement age for new employees and put in place new formulas for calculating pensions.

The state also provides retirement programs for many local city and county workers. And many cities have been forced to slash services as their pension bills have skyrocketed in recent years.

(AP) ? Former Penn State assistant football coach Jerry Sandusky has been recommended for designation as a sexually violent predator, a legal status that would require lifetime registration with authorities, according to a person who has read an assessment board's report to a judge in the case.

The recommendation from the Sexual Offenders Assessment Board was disclosed to The Associated Press on Thursday by the person, who spoke on condition of anonymity because of the report's confidential nature.

Sandusky, 68, was convicted in June of sexually abusing 10 boys over a 15-year period. He is jailed awaiting sentencing and maintains his innocence.

Sandusky, given his age and the serious nature of the crimes of which he was convicted, is likely to receive a sentence that will keep him in prison for life. No sentencing date has been announced.

Pennsylvania law designates certain offenders as sexually violent predators if they are considered to have mental abnormalities or personality disorders that make them likely to engage in predatory sexually violent offenses.

If prosecutors pursue the sexually violent predator status and Sandusky opposes it, Judge John Cleland will decide whether it is merited.

A spokesman for the attorney general's office declined to comment on Thursday, and Sandusky defense attorney Joe Amendola did not return phone and email messages seeking comment.

Sexual Offenders Assessment Board spokesman Leo Dunn said the board does not comment on any case, but he noted it has never failed to complete an assessment within 90 days, as required. The judge ordered Sandusky's evaluation by the board on June 22, shortly after the jury verdict.

Dunn said such evaluations are assigned to an investigator, who then reports his or her findings to a board member. The board member produces an evaluation, which includes a recommendation.

Some sex offenders must register under the Pennsylvania Megan's Law for 10 years, but that requirement is lifelong for sexually violent predators, who must update their residences to the state police on a quarterly basis and prove they are participating in approved counseling.

Also, the chief law enforcement official in the community where a sexually violent predator lives is required to notify the public by producing a flier that bears the offender's name, address, photograph and offense.

Eight young men testified against Sandusky, describing a range of abuse that went from grooming and manipulation to fondling, oral sex and anal rape when they were boys and included acts that occurred inside Penn State team showers.

One young man testified his muffled screams from the basement of the Sandusky home in State College, where Penn State is based, went unanswered as Sandusky attacked him.

"He got real aggressive and just forced me into it," the 18-year-old testified. "And I just went with it ? there was no fighting against it."

Prosecutors said Sandusky used his status as a Penn State football icon and the charity for youth he founded, The Second Mile, to attract victims. He was arrested in November after a grand jury investigation that also led to charges of perjury and failure to report suspected abuse against university administrators Tim Curley and Gary Schultz. Those charges, which the men deny, have not gone to trial.

Hall of Fame football coach Joe Paterno was fired by the university's board of trustees days after Sandusky's arrest, and the scandal also cost university president Graham Spanier his job. Paterno died of lung cancer in January, while Spanier, who has not been charged with any crime, remains a tenured faculty member.

Federal Court Rejects Texas Voter ID Law, Calls 'Unforgiving' to Poor, Minorities

WASHINGTON (AP) ? A federal court on Thursday rejected a Texas law that would require voters to present photo IDs to election officials before being allowed to cast ballots in November.

A three-judge panel in Washington unanimously ruled that the law imposes "strict, unforgiving burdens on the poor" and noted that racial minorities in Texas are more likely to live in poverty.

The decision involves an increasingly contentious political issue: a push, largely by Republican-controlled legislatures and governors' offices, to impose strict identification requirements on voters.

Republicans are aggressively seeking the requirements in the name of stamping out voter fraud. Democrats, with support from a number of studies, say fraud at the polls is largely non-existent and that Republicans are simply trying to disenfranchise minorities, poor people and college students ? all groups that tend to back Democrats.

In the Texas case, the Justice Department called several lawmakers, all of them Democrats, who said they detected a clear racial motive in the push for the voter ID law. Lawyers for Texas argued that the state was simply tightening its laws. Texas called experts who demonstrated that voter ID laws had a minimal effect on turnout. Republican lawmakers testified that the legislation was the result of a popular demand for more election protections.

The judges in the Texas case are Rosemary Collyer, an appointee of President George W. Bush; Robert Wilkins, an appointee of President Barack Obama; and David Tatel, an appeals court judge appointed by President Bill Clinton.

Tatel, writing for the panel, called the Texas law "the most stringent in the nation." He said it would impose a heavier burden on voters than a similar law in Indiana, previously upheld by the Supreme Court, and one in Georgia, which the Justice Department allowed to take effect without objection.

The decision comes the same week that South Carolina's strict photo ID law is on trial in front of another three-judge panel in the same federal courthouse. A court ruling in the South Carolina case is expected before the November election.

During an appearance in Houston in July, Attorney General Eric Holder said Texas' photo ID requirement amounts to a poll tax, a term that harkens back to the days after Reconstruction when blacks across the South were stripped of their right to vote. The attorney general told the NAACP that many Texas voters seeking to cast ballots would struggle to pay for the documents they might need to obtain the required photo ID.

Last December, South Carolina's voter ID requirement became the first such law to be rejected by the Justice Department in nearly 20 years. Republican presidential candidate Mitt Romney said the attorney general made a "very serious error" by blocking it. Romney said the requirement is easy to meet and will stem voter fraud.

"We don't want people voting multiple times" and "you can get a photo ID free from your state. You can get it at the time you register to vote," Romney said.

Assistant Attorney General Thomas Perez, the Justice Department's chief civil rights enforcer, has said the Texas and South Carolina photo ID laws will hinder many citizens, particularly minorities, in exercising their right to vote.

Across much of the South, the Voting Rights Act of 1965 is viewed as an overly intrusive burden on the states ? a relic once used by the Justice Department's civil rights division to remedy discriminatory practices that no longer exist. Under Section 5 of the act, Texas, South Carolina and all or parts of 14 other states must obtain clearance from the Justice Department's civil rights division or a federal court before carrying out changes in elections. The states are mostly in the South and all have a history of discriminating against blacks, American Indians, Asian-Americans, Alaskan Natives or Hispanics.

Last year, new voter ID laws passed in Kansas, Mississippi, Rhode Island and Wisconsin. In addition to Texas and South Carolina, Alabama and Tennessee tightened existing voter ID laws to require photo ID. Governors in Minnesota, Missouri, Montana, New Hampshire and North Carolina vetoed strict new photo ID laws.

This year, Pennsylvania enacted its own law and voting-rights groups who filed suit in an effort to stop it are appealing to the state Supreme Court. A hearing is scheduled for Sept. 13 in Philadelphia. The Republican administration of Gov. Tom Corbett says a U.S. Justice Department inquiry into the state's tough new voter identification law is politically motivated. The department is requesting the state's voter registration list, plus any database of registered voters who lack a valid photo ID that the law requires voters to show before their ballots can be counted.

In Wisconsin, a county judge ruled in July that the state's new photo ID law impairs the right to vote. In an appeal, Wisconsin Attorney General J.B. Van Hollen, a Republican, is arguing that the ID law doesn't impose an undue burden because voters can get free state ID cards.

Since the last election, Pennsylvania, Kansas, Wisconsin and Texas and other states have tried to limit or ban the use of student IDs as voter identification. In Florida, lawmakers tried to limit "third party" organizations, including student groups, from registering new voters.

At a recent congressional hearing, Republican Rep. Steve King of Iowa said the decision to contest the Texas and South Carolina laws shows insensitivity by the Justice Department to voter fraud.

Election administrators and academics who monitor the issue said in-person fraud is rare because someone would have to impersonate a registered voter and risk arrest.

A report by the Brennan Center for Justice determined that new voting restrictions could suppress the votes of more than 5 million young, minority, low-income and disabled voters.

AMAZON: We're Sold Out Of The Kindle Fire - Business Insider

In a somewhat unusual press release Amazon announced that it sold out of its $200 tablet, the Kindle Fire.

In the release, CEO Jeff Bezos says, "Kindle Fire is sold out, but we have an exciting roadmap ahead?we will continue to offer our customers the best hardware, the best prices, the best customer service, the best cross-platform interoperability, and the best content ecosystem."

He appears to be saying Amazon will not make any more Kindle Fires, at least not the current model.

Amazon is hosting a special media event one week from today where it's expected to announce the next wave of Kindle Fires and e-readers. If Amazon is sold out of Fires, it would follow that the next tablets will be available for sale right away.

In Amazon's release it says it captured 22% of the tablet market in the U.S. over the last nine months. Its cheap tablet was appealing to people who didn't want to pay $400-$500 for the iPad. But Amazon now faces competition from Google with the Nexus 7, and Apple is reportedly going to release an iPad Mini which will compete with the Kindle Fire.

Amazon will have to make the next generation of the Kindle Fire significantly better if it wants to compete with Google and Apple.

A petition for Post Grant Review (PGR) must be filed no later than nine months after the issue date of a patent or, for claims broadened in a reissue, nine-months after the date of the certificate.? A third party may challenge a patent under PGR based on any ground that may be raised under 35 U.S.C. ? 282(b)(2) or (3) including patent subject matter eligibility or utility under 35 U.S.C. ? 101, novelty under 35 U.S.C. ? 102, Obviousness under 35 U.S.C. ? 103 and enablement, written description and definiteness under 35 U.S.C. ? 112.? A PGR may only be instituted for a patent having claims with an effective filing date after March 16, 2013.? A PGR must be filed no later than one year after the petitioner has been sued for infringement and cannot be instituted if the petitioner has filed a declaratory judgment action against the patent.

A PGR begins with the filing of a petition in which the Petitioner must identify, for each challenged claim, the specific statutory grounds for challenging the claim and how the challenged claim is to be construed.? The Petitioner must also provide an analysis showing how the construed claim is unpatentable under the statutory grounds.? Although the Petitioner is required to construe the claims, the Board will review each claim according to its broadest reasonable interpretation in view of the specification as it would be understood by a person skilled in the art.

Where the petitioner challenges a claim based on prior art, the analysis must include an element-by-element comparison of the claim as construed against the prior art.? For non-prior-art rejections, the analysis must state how the claim fails to comply with the statute.? The PGR petition may also include supporting evidence in the form of exhibits, affidavits, declarations and expert reports.? Any such supporting evidence must be referenced in the claim analysis.? The petition must also be accompanied with the appropriate fee, $35,800 for up to 20 challenged claims and $800 for each additional challenged claim.? The petition is limited to 80 pages, double spaced with 14 point font, no matter how many claims are challenged.? Claim charts, however, may be single spaced or they may be provided in an expert?s opinion where they would not be counted toward the page limit.

Three months after the filing of the petition, the Patent Owner may file a preliminary response.? This response may include exhibits but may not include any testimonial evidence such as affidavits or expert reports.? If the Patent Owner has reason to believe that the Requester may not have standing to challenge the patent, however, the Patent Owner may be able to present testimonial evidence relating to the standing of the Petitioner after filing a motion with the Board.

Based on the petition and the preliminary response, if one is filed, the Board will determine whether to institute a PGR and what claims will be included.? The Board analyzes each claim to determine if, based on the submitted evidence, the Petitioner has standing and is more likely than not that at least one of the challenged claims is unpatentable.? A PGR may also be instituted if the Board determines that the petition raises a novel or unsettled legal question that is important to other patents or patent applications.

When the PGR is instituted, the Board will issue a scheduling order, specifying times for the various phases of the trial. Based on this order, the Patent Owner may begin to take discovery.? Under Routine Discovery, the Petitioner is required to provide any exhibits to the Patent Owner and to present any affiants, declarants or experts whose testimony was referenced in the Petition for cross-examination. ?Petitioner is allowed similar Routine Discovery after the Patent Owner files the Response to the Petition.? Under Routine Discovery, each party is also required to provide any relevant information that is inconsistent with a position advanced by the party during the proceeding concurrently with the filing of the documents or things that contains the inconsistency.? Unless the Patent Owner and Petitioner agree to one of the Mandatory Discovery provisions under 37 C.F.R. ? 42.51, all other discovery by the Patent Owner and Petitioner must be requested by motion which requires a showing of good cause as to why the discovery is needed.

Within one month of the institution of the PGR, the Petitioner or the Patent Owner may provide supplemental information as long as that information is relevant to a claim for which the trial has been instituted. Submission of supplemental information after this one month period may only be made by motion to the Board and requires a showing that the submission is in the interests of justice.

A scheduling conference will be held one month after the institution of the PGR in which the Petitioner or Patent Owner may ask the Board to adjust the time limits in the scheduling order and request additional discovery.? The Patent Owner must also obtain permission to file a reasonable number of claim amendments.? Matters discussed at the scheduling conference are presented in motions to the Board prior to the conference.

The Patent Owner?s response to the petition is due at a time determined in the scheduling order.? The default time is three-months after the institution of the PGR but this time may be adjusted by the Board.? Patent Owner?s response may include a motion to amend including a reasonable number of claim amendments.? The default is one replacement claim for each contested claim but more amended claims can be provided if allowed during the scheduling conference.? The patent owner may make additional claim amendments, after the amendments made with the Patent Owner?s Response, on motion to the Board but any additional amendments require a showing of good cause or agreement between the parties.

Once the Patent Owner?s response has been filed, the Petitioner may begin Routine Discovery and, if agreed with the Patent Owner, Mandatory Discovery.? At a time determined in the scheduling order (default three months), the Petitioner may then file a reply to the Patent Owner?s Response and an Opposition to the Patent Owner?s motion to amend.

After the Petitioner?s Opposition, the Patent Owner may file a reply to the Opposition at a time determined in the scheduling order (default one month).? After the filing of this reply, the PGR enters a period for observations and motions to exclude evidence.? During this period, either party may request an Oral Hearing.? After the Oral Hearing, the Board issues the Final Written Decision.

Once the Final Written Decision has been issued and the conclusion of any appeals to the Federal Circuit, the Petitioner is estopped from challenging any claim that was finally adjudicated based on any ground that was raised or reasonably could have been raised.? This estoppel applies to proceedings before the PTO, District Court and ITC.? The Patent Owner is also estopped from pursuing, in the USPTO (e.g. in a continuation application) any claim which is not patentably distinct from a claim that was finally refused or canceled in the PGR.

Inter Partes Review

Inter Partes Review (IPR) is provided as a substitute for the Inter Partes Reexamination proceedings which will not be available after September 16, 2012.? IPR is similar to PGR but has several key differences.

First, the petitioner may not file a petition for IPR until the later of nine-months after the issue date of the patent and the conclusion of any PGR proceeding that has been instituted for the patent.

Second, the grounds for invalidating a patent under IPR are more restricted; the IPR petition may address only issues of novelty and obviousness based on patents and printed publications.

Third, the standard for instituting an IPR, ?reasonable likelihood that at least one of the claims challenged in the petition is unpatentable,? is less stringent than for a PGR, allowing the Board more latitude for instituting an IPR.

Fourth, the standard for obtaining motion-based discovery is more stringent for IPR, an ?interest of justice? standard rather than the ?good cause? standard for PGR.

Fifth, the page limits and fees for an IPR are lower.? An IPR Petition, Preliminary Submission and Reply are limited to 60 pages each and the fee for challenging up to 20 claims is $27,200 and $600 for each additional claim.

Transitional Program for Covered Business Method Patents

?The Transitional Program for Covered Business Method Patents (CBM) allows a party who has been sued or threatened with suit based on a financial business method patent to be able to use a procedure similar to PGR to determine the validity of the patent.? Although CBM follows the procedures for PGR, there are several important differences.

First, a CBM may be instituted for any eligible patent as of September 16, 2012 based on 35 U.S.C. ?? 101, 102, 103 or 112.? If it is instituted against a patent having claims with an effective filing date prior to March 16, 2013, however, the prior art that may be used to invalidate the patent is limited to prior art under the current 35 U.S.C. ? 102(a) and prior art that disclosed the invention more than one year before the filing date of the application for the patent and would have been prior art under 35 U.S.C. ? 102(a) as of the invention date of the patented invention.? Challenges based on prior art under 35 U.S.C. ?? 102(e), (f) and (g) are not allowed.

Second, a CBM cannot be instituted during the period that a PGR could be instituted against the patent.

Third, the Petitioner must have been sued or have standing to bring a declaratory judgment action against the patent.

Fourth, the claims challenged in a CBM must concern a method or corresponding apparatus for performing data processing or other operations used in the practice, administration, or management of a financial product or service.? A CBM may not challenge a claim for a technological invention.? A technological invention is one in which the claimed subject matter as a whole recites a technological feature that is novel and unobvious over the prior art; and solves a technical problem using a technical solution.? The burden of proving that a claim is not directed to a technological invention is on the Petitioner.

Fifth, the estoppel for a CBM is not as broad for proceedings in District Court and before the ITC ? the petitioner is estopped from raising only issues that were actually raised.? The estoppel for subsequent PGR or IPR proceedings before the USPTO is the same: raised or reasonably could have been raised.

Bonanza of black holes, hot DOGs: NASA's WISE survey uncovers millions of black holes

ScienceDaily (Aug. 29, 2012) ? NASA's Wide-field Infrared Survey Explorer (WISE) mission has led to a bonanza of newfound supermassive black holes and extreme galaxies called hot DOGs, or dust-obscured galaxies.

Images from the telescope have revealed millions of dusty black hole candidates across the universe and about 1,000 even dustier objects thought to be among the brightest galaxies ever found. These powerful galaxies, which burn brightly with infrared light, are nicknamed hot DOGs.

"WISE has exposed a menagerie of hidden objects," said Hashima Hasan, WISE program scientist at NASA Headquarters in Washington. "We've found an asteroid dancing ahead of Earth in its orbit, the coldest star-like orbs known and now, supermassive black holes and galaxies hiding behind cloaks of dust."

WISE scanned the whole sky twice in infrared light, completing its survey in early 2011. Like night-vision goggles probing the dark, the telescope captured millions of images of the sky. All the data from the mission have been released publicly, allowing astronomers to dig in and make new discoveries.

The latest findings are helping astronomers better understand how galaxies and the behemoth black holes at their centers grow and evolve together. For example, the giant black hole at the center of our Milky Way galaxy, called Sagittarius A*, has 4 million times the mass of our sun and has gone through periodic feeding frenzies where material falls towards the black hole, heats up and irradiates its surroundings. Bigger central black holes, up to a billion times the mass of our sun, may even shut down star formation in galaxies.

In one study, astronomers used WISE to identify about 2.5 million actively feeding supermassive black holes across the full sky, stretching back to distances more than 10 billion light-years away. About two-thirds of these objects never had been detected before because dust blocks their visible light. WISE easily sees these monsters because their powerful, accreting black holes warm the dust, causing it to glow in infrared light.

"We've got the black holes cornered," said Daniel Stern of NASA's Jet Propulsion Laboratory, Pasadena, Calif., lead author of the WISE black hole study and project scientist for another NASA black-hole mission, the Nuclear Spectroscopic Telescope Array (NuSTAR). "WISE is finding them across the full sky, while NuSTAR is giving us an entirely new look at their high-energy X-ray light and learning what makes them tick."

In two other WISE papers, researchers report finding what are among the brightest galaxies known, one of the main goals of the mission. So far, they have identified about 1,000 candidates.

These extreme objects can pour out more than 100 trillion times as much light as our sun. They are so dusty, however, that they appear only in the longest wavelengths of infrared light captured by WISE. NASA's Spitzer Space Telescope followed up on the discoveries in more detail and helped show that, in addition to hosting supermassive black holes feverishly snacking on gas and dust, these DOGs are busy churning out new stars.

"These dusty, cataclysmically forming galaxies are so rare WISE had to scan the entire sky to find them," said Peter Eisenhardt, lead author of the paper on the first of these bright, dusty galaxies, and project scientist for WISE at JPL. "We are also seeing evidence that these record setters may have formed their black holes before the bulk of their stars. The 'eggs' may have come before the 'chickens.'"

More than 100 of these objects, located about 10 billion light-years away, have been confirmed using the W.M. Keck Observatory on Mauna Kea, Hawaii, as well as the Gemini Observatory in Chile, Palomar's 200-inch Hale telescope near San Diego, and the Multiple Mirror Telescope Observatory near Tucson, Ariz.

The WISE observations, combined with data at even longer infrared wavelengths from Caltech's Submillimeter Observatory atop Mauna Kea, revealed that these extreme galaxies are more than twice as hot as other infrared-bright galaxies. One theory is their dust is being heated by an extremely powerful burst of activity from the supermassive black hole.

"We may be seeing a new, rare phase in the evolution of galaxies," said Jingwen Wu of JPL, lead author of the study on the submillimeter observations. All three papers are being published in the Astrophysical Journal.

Syria's Assad acknowledges struggles in civil war

BEIRUT (AP) ? In a striking admission, President Bashar Assad said in an interview broadcast Wednesday that his armed forces will need time to defeat the rebels and addressed the string of defections from his authoritarian regime.

The comments amounted to an acknowledgment that even though the opposition lacks the government's tanks and airplanes, their tenacity and tactical creativity ? combined with the military's struggle to fight on multiple fronts ? have yielded a stalemate that could prolong the civil war with many more dead.

Over the past few months, Syria's military has increasingly been stretched thin fighting on multiple fronts against rebels seeking to oust Assad. His forces have been unable to quell the rebellion as it spread to the capital, Damascus, with significant clashes that began in July and to Syria's largest city, Aleppo, a few weeks later. At the same time, the military is fighting smaller scale battles in a string of other cities and towns around the country.

With neither side making significant advances, the conflict is looking more like a war of attrition that could be very drawn out.

"We are fighting a regional and global war, so time is needed to win it," Assad said in an interview with the pro-regime private TV station Dunya. "We are moving forward. The situation is practically better but it has not been decided yet. That takes time," he told the station, which is majority owned by Rami Makhlouf, a cousin of Assad and one of Syria's wealthiest men.

"If the armed forces wanted to use the entire range of its firepower, it can wipe out many areas. But this will be unacceptable," said Assad.

Assad also appeared to make light of the significant number of defections, some of them senior military and political officials, including the prime minister.

"Defections are a positive process. Generally, it is self-cleansing of the state and the nation," said Assad. "If there is a Syrian citizen who knows of someone who wishes to flee but is hesitant to do so he should encourage him," he said with a smile. "Whoever flees is either weak or bad. A patriotic or a good person does not flee."

Assad claimed there were cases when authorities knew in advance of officials who wanted to flee and allowed them to do so unhindered. But he did not provide any specifics to back up the claim.

Taken together with his comments to a visiting Iranian official over the weekend, Assad shows willingness for an even more prolonged conflict, even with more than 20,000 estimated dead in more than 17 months of fighting.

His regime, he told the senior Iranian official, would continue the fight against the rebels "whatever the price."

Some analysts saw the interview as a counter-attack by the regime to burnish its image in the face of recent military gains by the rebels.

Analysts and rights activists say the military has been unable to defeat the rebels in large part because of the tactics of its enemy ? a rag-tag army of civilians-turned-fighters and defected soldiers without a clear chain of command.

"It is extremely difficult to stop an insurrection that has spread so widely, even with far superior firepower, as demonstrated by the U.S. experience in Iraq and Afghanistan," said Christopher Chivvis, a senior analyst with the Rand Corporation. "The task becomes even harder when there are neighboring countries that support the insurrection"

The insurgents do not have to hold territory and can take advantage of the fact that the military cannot fight as easily on multiple fronts, said Michael W. Hanna, a Middle East expert who monitors the Syrian conflict for the Century foundation in New York.

Hanna also picked up on Assad's claim that the military is holding back on using its full power.

"If the Syrian military wants to retake territory it can do so but will be forced to use disproportionate force," he said. "Such actions run the perennial risk of alienating civilians and creating new motivations for anti-government actions."

Hisham Jaber, a retired Lebanese army general who heads a Beirut-based think tank, argues that Assad's military cannot employ overwhelming force to put down the fighting in Damascus and Aleppo, the country's two largest cities with major political and economic importance.

"Assad may be ready to destroy Homs and Hama (cities in central Syria) but he cannot do that in Aleppo, for example, and does want heavy casualties among civilians," he said. "At the end, a regular army is not suited for guerrilla warfare."

Syrian activists speak of the limitations faced by the regime in using everyone in uniform. Assad's Alawite-led regime, they explain, is unable to trust military personnel from the majority Sunni Muslim sect to fight mostly Sunni rebels.

Assad is a follower of the Alawite sect, an offshoot of Shiite Islam.

Other activists speculate that Sunni pilots have been grounded out of fear they would defect with their warplanes.

On the other hand, they say the rebels are taking advantage of growing logistical and moral support from the civilian population in many areas, while the military was being increasingly seen as an oppressive force that kills with impunity.

Rights groups monitoring the violence now report the deaths of up to 250 or more Syrians on daily basis, though the figures are impossible to independently verify. The fighting has been intense enough to force hundreds of thousands to flee their homes, seeking refuge elsewhere in the country or in neighboring nations.

Assad appeared confident and relaxed in the interview and at times tried to laugh off or make light of serious issues in the conflict.

He responded with a hearty laugh when told by the interviewer about speculations and rumors about his whereabouts.

"I am here with you in Damascus in the presidential palace," he said. "They have not been able until now to instill fear in my heart or the heart of Syrians. Everyone (in Syria) is worried about the country and that's natural. "

Assad has rarely appeared in public since four of his top security officials were assassinated in a July 18 rebel bombing in Damascus.

He sought to deflect any charges of military failure, reverting to his favored rhetoric that the uprising is a conspiracy by foreign powers to weaken Syria.

"What is taking place (in Syria) is neither a revolution, nor a spring. It is a conspiracy," he said, alluding to the Arab Spring revolutions that have topped authoritarian regimes in Tunisia, Egypt, Libya and Yemen.

Assad paid tribute to his supporters at home, saying they stood steadfastly behind him, and also praised the armed forces.

But he criticized the leaders of onetime ally Turkey.

"The state of Turkey bears direct responsibility for the blood being shed in Syria."

Syrian officials routinely cite neighboring Turkey, along with Saudi Arabia and Qatar, as among the rebels' main supporters, providing them with money and weapons.

Turkish Foreign Minister Ahmet Davutoglu said on Wednesday he would press the U.N. Security Council to set up a safe haven inside Syria to protect thousands of people fleeing the violence. Turkey has long been floating the idea of a no-fly zone, or buffer zone, to protect displaced Syrians from attacks by Assad's forces, but the issue has become more pressing now the number of refugees in Turkey has exceeded 80,000 ? a number it says approaches its limits.

"We expect the U.N. to step in and protect the refugees inside Syria, and if possible, to shelter them in camps there," Davutoglu told reporters before leaving for New York to attend Thursday's high-level U.N. Security Council meeting on Syria.

On that prospect, Assad said: "Talk about safe havens does not exist and is unrealistic, even for countries that have assumed the role of a foe."

Lexmark to cut 1,700 jobs, stop making inkjets

(AP) ? Lexmark is cutting 1,700 jobs, or almost 13 percent of its workforce, and says it will stop making inkjet printers as part of a drive to cut costs as it deals with shrinking sales of inkjets.

The printer and software company said Tuesday that it will close its inkjet supply plant in the Philippines by the end of 2015. It is also putting its inkjet technology up for sale.

Lexmark had about 13,300 employees as of Dec. 31. Lexmark has been shifting its focus from consumer inkjet printers, focusing on higher-profit laser printers and supplies for businesses and software services.

It has made a series of acquisitions, including Luxembourg's BDGB Enterprise for about $148 million. This purchase included BDGB's U.S. subsidiary Brainware Inc., which provides data capture software to businesses.

The job cuts include about 1,100 manufacturing jobs. Lexmark says the moves will save it $85 million in 2013 and $95 million a year by 2015. It expects to book costs of $160 million over three years for the restructuring.

Lexmark International Inc., based in Lexington, Ky., says it will continue to provide support and supplies for its inkjet printers still in use.

The restructuring is the second in less than a year for Lexmark, which said in January it would cut 625 jobs.

Lexmark in July reported second-quarter results that fell short of Wall Street expectations as the economic crisis in Europe pulled down demand.

Lexmark's stock closed Friday at $19.01 per share. It has fallen from over $73 in 2006 and has sunk as low as $16.10 in the past year.

In June San Antonio-based AirStrip Technologies announced that it was expanding its suite of mobile patient monitoring applications to enable physicians to more easily access information housed in various electronic health record systems (EHRs) via their mobile devices via an acquisition of San Diego-based healthcare system Palomar Health?s EHR-agnostic and mobile-enabled MIAA (Medical Information Anytime Anywhere) platform. Because of increasing consolidation between organizations that own healthcare facilities and the fact that it is not unusual for the same healthcare system to have different EHR systems installed in its various facilities, the need for a mobile app that can access data from multiple records systems is crucial.

Similarly, keeping tabs on health IT systems utilizations among a healthcare organizations many facilities can prove to be a challenge, especially when multiple hospital information systems and EHRs are being used.

AirStrip acquired the software for its new meaningful use track from San Diego-based Care Automation, in a deal similar to the one it inked with Palomar: ?AirStrip owns the global licensing, marketing and distribution rights to the Meaningful Use Tracker, along with the ability to modify the solution to seamlessly integrate with the existing AirStrip platform,? the company wrote.

The company is now looking to pilot the technology and more news on that front should be coming in the weeks ahead.
